Effective Date: April 2026
This document govern your use of SPAR Houston’s membership platform, token-based booking system, digital services, and gym facilities. By signing up, purchasing tokens, or booking a class, you agree to the terms outlined below. Please read both documents carefully before proceeding.
2.1 Acceptance of Terms
By creating a membership account, purchasing tokens, booking a class, or using any SPAR Houston digital service, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. These terms apply to all members, guests, and visitors.
2.2 Membership Eligibility
Membership at SPAR Houston is open to individuals who:
• Are 18 years of age or older, or have documented parental/guardian consent if under 18
• Have completed and signed the SPAR Houston Member Waiver
• Have provided accurate personal information during registration
• Have consented to receive SMS communications from SPAR Houston
SPAR Houston reserves the right to refuse or revoke membership at its sole discretion for violation of these terms, the member waiver, or gym conduct standards.
2.3 Token System
Purchasing Tokens
SPAR Houston operates a token-based class booking system. Tokens are purchased in packages and used to book classes. Available packages are:
• Starter Pack — $35 for 2 tokens
• Standard Pack — $50 for 4 tokens
• Value Pack — $300 for 24 tokens
Token Validity and Expiry
All tokens are valid for 365 days from the date of purchase. Each token purchase batch carries its own expiry date. Tokens are deducted on a first-in, first-out (FIFO) basis — the oldest batch is used first. Members will receive an automatic SMS alert 30 days before any token batch expires. Expired tokens are forfeited without refund.
Token Costs per Class Type
Token deductions vary by class type as follows:
• Half-value class — 1 token
• Standard classes (SPAR Strength, SPAR Fit, Yoga Yang, Yoga Yin, Pilates) — 2 tokens
• Private session — 6 tokens
• Premium class — 8 tokens
Token Booking Gate
Members must have sufficient tokens to complete a class booking. If a member attempts to book with an insufficient token balance, they will be redirected to the token purchase page before the booking can be confirmed.
2.4 Class Booking
Classes are booked through SPAR Houston’s online booking platform. Upon successful booking, a QR check-in ticket is automatically generated and delivered via SMS and email. This QR ticket serves as proof of booking and must be presented at the gym door for entry.
Class bookings are subject to availability. SPAR Houston reserves the right to cancel or reschedule classes due to instructor availability, low enrollment, or other operational reasons. Members will be notified in advance and affected tokens will be returned to their balance.
2.5 Check-In Policy
Members check in at the gym using their QR ticket displayed on their mobile device or by providing their registered phone number to staff. Check-in is confirmed at the door by the iPad kiosk system. Each QR ticket is valid for a single check-in and cannot be reused for the same session.
Members are encouraged to arrive 5–10 minutes before class start time. Late arrivals may be denied entry at the instructor’s discretion.
2.6 Ticket Transfer Policy
Class tickets (QR codes) are transferable. A member who cannot attend a booked class may forward their QR ticket to another individual. The holder of the QR code at check-in will be granted access regardless of who originally booked the class. SPAR Houston is not responsible for verifying the identity of ticket holders beyond QR validation.
If a ticket is transferred to a non-member, the recipient will be prompted to create a membership account after their first class. Token balances are non-transferable between member accounts. Only class tickets (QR codes) may be transferred.
2.7 No Refund Policy
All token purchases are final and non-refundable. Once a class booking is confirmed and tokens are deducted, no refund will be issued regardless of attendance. Members who cannot attend a booked class are encouraged to transfer their QR ticket to another person as described in Section 2.6.
In the event SPAR Houston cancels a class, affected tokens will be returned to the member’s balance within 24 hours.
2.8 Payment
All payments are processed securely through Stripe. By purchasing tokens, you authorize SPAR Houston to charge your selected payment method for the amount of the selected token package. SPAR Houston does not store your payment card information on its systems.
In the event of a failed payment, the token purchase will not be completed and no tokens will be added to your account. Members experiencing payment issues should contact their bank or credit card provider.
2.9 Member Conduct
Members are expected to conduct themselves in a respectful and safe manner at all times while on SPAR Houston premises and within its digital community. The following are prohibited:
• Harassment, intimidation, or threatening behavior toward staff or other members
• Use of gym equipment in an unsafe or unauthorized manner
• Misuse of the token or booking system, including fraudulent account creation
• Sharing account credentials or allowing others to use your membership account
• Recording or photographing other members without consent
SPAR Houston reserves the right to immediately terminate the membership of any member who violates these conduct standards without refund of remaining tokens.
2.10 Limitation of Liability
To the fullest extent permitted by applicable law, SPAR Houston shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, facilities, or digital platform. Our total liability to any member for any claim shall not exceed the amount paid by that member for tokens in the 90 days preceding the claim.
2.11 Indemnification
You agree to indemnify and hold harmless SPAR Houston, its owners, employees, contractors, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of our services, your violation of these Terms of Service, or your violation of any third-party rights.
2.12 Governing Law and Dispute Resolution
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, USA, without regard to its conflict of law provisions. Any disputes arising from these terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to binding arbitration in Harris County, Texas, in accordance with the American Arbitration Association rules.
2.13 Modifications to Terms
SPAR Houston reserves the right to modify these Terms of Service at any time. When changes are made, members will be notified via SMS or email. The updated terms will be effective upon notification. Continued use of SPAR Houston’s services after notification constitutes acceptance of the revised terms.
2.14 Entire Agreement
These Terms of Service, together with the SPAR Houston Member Waiver and Privacy Policy, constitute the entire agreement between you and SPAR Houston regarding your membership and use of our services. They supersede all prior communications, representations, or agreements, whether written or oral.
